General travel conditions UHK Spezialreisen Italien UG (limited liability) & Co.KG, Kulmbach
The subject of the above-mentioned companies is the organization of trips and the arrangement of individual travel services. Unless otherwise specified below, the statutory regulations apply.

1. Registration and conclusion of the travel contract
With your registration you are offering UHK Special Travel Italy to the following named "tour operator" to conclude a travel contract. Registration can be made in writing, by telephone or online via the Internet. The contract is concluded with the written confirmation of the tour operator.

2. Payment
After receiving the travel confirmation, 20% of the travel price is due as a deposit. The remaining amount must be received in an account of the tour operator at least 30 days before the start of the trip. Otherwise, the tour operator is entitled to withdraw from the travel contract and to calculate cancellation costs in accordance with point 5. Exceptions can only be made in writing. Payments are only to be made to the organizer.

3. Services
The scope of the services results exclusively from the descriptions printed in this brochure and other documents for the respective period. Illustrations and special conditions as well as additional services require the express confirmation of both contractual partners.

4. Changes to services and prices prior to departure
The minimum number of participants depends on the invitation to travel. If this number is not reached, the organizer is entitled to cancel the trip. The down payment will then be refunded in full. If it becomes known before the start of the trip that individual travel services cannot be provided or cannot be provided in accordance with the contract, the tour operator is entitled to change the services if equivalent and reasonable replacement services can be offered. Replacement services are considered equivalent and reasonable if they correspond to the agreed performance standard and the type of travel booked and the travel purpose is not objectively impaired objectively. The tour operator is obliged to inform the customer immediately of significant changes in services, insofar as this is technically and temporally possible.
The tour operator reserves the right to change the sequence of the program sequences listed in the travel description if this appears to make sense.
The tour operator reserves the right to increase the advertised and confirmed prices to the extent that the costs increase after the conclusion of the travel contract in the event of an increase in transport costs or taxes for certain services such as entry fees, airport fees, mineral oil and ecology taxes etc. or taxes for certain services per person or per seat affects the travel price if there are more than four months between receipt of the travel confirmation / invoice and the agreed travel date. In this case, the tour operator will inform you of the price changes immediately, but no later than 21 days before the start of the trip. Price increases after this time are not permitted. In the event of a price increase of more than 5% of the travel price or a significant change to an essential travel service, you are entitled to withdraw from the travel contract without fees or to request another, at least equivalent trip from the travel program of the travel organizer, if the tour operator is able to do so is to offer you one. You have the right to assert this against the tour operator immediately after declaring the price increase or changing the travel service.

5. Withdrawal
The traveler is entitled to withdraw from the contract in writing before the start of the trip. In this case, the tour operator is entitled to charge the following flat rates for a withdrawal:

For bus and air travel, group travel
Up to 45 days before arrival 20% of the travel price
44 - 30 days before arrival 30% of the travel price
29 - 21 days before arrival 35% of the travel price
20 - 11 days before arrival 50% of the travel price
10 - 3 days before arrival 65% of the travel price
2 - 1 days before arrival 95% of the travel price
On the day of arrival 100% of the travel price

Tickets and flight tickets cannot be taken back.
Exceptions can only be made in writing. This rule also applies in the event of partial resignation or non-appearance of groups. However, the traveler is free to prove that the damage was less. Rebookings within 21 days before arrival are considered a cancellation with a new booking at the same time.

6. Warranty and compensation
The tour operator guarantees within the framework of the legal regulation that the trip is not subject to errors and has the guaranteed properties.

Travel price reduction
A reduction in the travel price can be requested by the traveler for the duration of a non-contractual provision of travel services.
A reduction in the travel price cannot be granted if the traveler fails to report any deficiencies during the trip that could have been remedied.
damages
The contractual liability of the tour operator is limited to the amount of three times the travel price, insofar as damage to the traveler was not caused deliberately, grossly negligent or by the tour operator or if the latter is responsible for damage caused to the traveler solely due to the fault of a service provider.
This does not apply to body damage. If legal regulations apply to a travel service to be provided by a service provider, according to which a claim for damages can only be asserted under certain conditions or restrictions, the tour operator can also appeal to the traveler.
Warranty and compensation as an intermediary
For no legal reason, the tour operator is not responsible for actions in connection with services that are only mediated as external services. Any warranty claims or claims for damages against the tour operator, which result from inadequate service provision or other behavior based on the behavior of the persons entrusted with the service provision, are excluded and can only be asserted against the mediated service providers within the scope of what is legally possible. If damage arises due to faulty agency services, the tour operator's contractual service is limited to three times the travel price, unless the damage occurred is attributable to willful or grossly negligent behavior by the tour operator during the agency.
Visa procurement, reimbursement of expenses
Advice on passport and visa requirements and the procurement of visas is only given when the customer specifically requests it. The tour operator is entitled to invoice the customer for the resulting costs (e.g. telecommunications costs, postage costs, processing fees, etc.). It is not liable for the timely issue and timely access of necessary visas, as far as the tour operator is not responsible for the delay.

7. Place of jurisdiction
The place of jurisdiction is Kulmbach. Kulmbach is also the local place of jurisdiction for persons who do not have a general place of jurisdiction in Germany or who no longer have it at the time the lawsuit is filed. The above jurisdiction agreements apply to all disputes arising from and in connection with the travel contract. The above agreement on the place of jurisdiction also applies to disputes arising from the assigned rights of one of our service providers, contractors or as the legal partner of these persons.
Deviations
Deviations from these travel conditions and verbal agreements are only effective if they are confirmed in writing by the tour operator.
Ineffectiveness of individual provisions
The ineffectiveness of individual provisions of this contract or parts of provisions does not result in the ineffectiveness of the entire contract. The ineffective provision or the ineffective part of a provision shall be replaced by such regulations that come as close as possible to the purpose of the economically desired.
